of 18), and handicap (disability)." The Site will not knowingly accept any real estate

IN NO EVENT WILL THE COMPANY BE LIABLE TO ANY PARTY FOR ANY DIRECT, INDIRECT, SPECIAL OR
OTHER CONSEQUENTIAL DAMAGES FOR ANY USE OF THIS WEB SITE, OR ON ANY OTHER HYPER LINKED WEB
SITE, INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS
OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM OR OTHERWISE, EVEN IF WE ARE EXPRESSLY
ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

via the Site. You acknowledge that the Company does not pre-screen or approve Content, but
that the Company shall have the right (but not the obligation) in its sole discretion to
refuse, delete or move any Content that is available via the Site, for violating the letter
or spirit of the Terms or for any other reason. You are solely responsible for obtaining any
necessary permission before reusing any copyrighted or trademarked material that is on the Site.
The Company may, in its sole discretion, edit, reclassify or reject any advertising copy
submitted by you. The Company does not guarantee the placement of any ad in a specific category.
Trademarks
BuySellListings™, BuySellListings.com™, Strategies 4 Business™, strategies4business.com™,
strategies4business.biz™, bizfuel™ and bizfuel.biz™ are proprietary marks of the Company. The
Company’s trademarks may not be used in connection with any product or service that is not
provided by the Company, in any manner that is likely to cause confusion among customers, or in
any manner that disparages or discredits the Company or the Site.
All other trademarks displayed on BuySellListing.com are the trademarks of their respective owners,
and constitute neither an endorsement nor a recommendation of those Vendors. In addition, such use
of trademarks or links to the web sites of Vendors is not intended to imply, directly or indirectly,
that those Vendors endorse or have any affiliation with the Company.
Membership/ User ID and Password
Your membership rights cannot be assigned, sublicensed, distributed, shared, viewed, accessed, or
otherwise transferred to anyone other than the registered member without the express written permission
of the Company. The Company requires that each registered user maintain a valid email address and a
password. Your access to BuySellListings.com may be blocked in the event your User ID or Password is
entered incorrectly.
You agree that use of your User ID and/or Password to access the BuySellListings.com site in connection
with a communication that you send to us shall be treated as your signature. The Company is entitled to
act on instructions received through the site under your password and without inquiring into the identity
of the person using that password nor are we under any obligation to monitor transactions to determine
that they are made on behalf of the account holder. You agree to hold the Company harmless as a result of
any damages you may incur as a result of same. For your protection, do not, under any circumstances,
disclose your password by telephone or to any one claiming to represent the Company; the Company employees
do not need and should not ask for your password. The Company has no responsibility for establishing the
identity of any person using your password. If, despite, the Company advice, you give your password to
anyone, you do so at your own risk. Anyone to whom you give your BuySellListings.com password or other
means of access will have full access to your accounts even if you attempt to limit that person's authority,
and actions or transactions conducted by such persons will be considered to be authorized by you. You must
notify the Company, promptly in the event that your password has been lost, stolen or otherwise compromised.
Conduct
You agree not to post, email, or otherwise make available Content that:
- constitutes or contains any form of advertising or solicitation if
(1) posted in areas of the Site which are not designated for such purposes; or
(2) emailed to Site users who have requested not to be contacted about other services, products or commercial interests;
- is unlawful, harmful, threatening, abusive, harassing, defamatory, pornographic, libelous, invasive of
another's privacy, harms minors in any way, any communication that constitutes (or encourages conduct that
would constitute) a criminal offense, gives rise to civil liability or otherwise violates any local, state,
national or international law;
- harasses, degrades, intimidates or is hateful toward an individual or group of individuals, including,
without limitation, on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
- impersonates any person or entity, including, but not limited to, a BuySellListings.com employee, or falsely
states or otherwise misrepresents your affiliation with a person or entity;
- includes personal or identifying information about another person within a classified ad without that person's
explicit consent;
- is false, deceptive, misleading, deceitful, misinformative, or constitutes "bait and switch";
- that violates the Fair Housing Act by stating, in any notice or ad for the sale or rental of any dwelling, a
discriminatory preference based on race, color, national origin, religion, sex, familial status or handicap (or violates
any state or local law prohibiting discrimination on the basis of these or other characteristics);
- that violates federal, state, or local equal employment opportunity laws, including but not limited to, stating in
any advertisement for employment a preference or requirement based on race, color, religion, sex, national origin, age,
or disability;
- with respect to employers that employ four or more employees, that violates the anti-discrimination provision of the
Immigration and Nationality Act, including requiring U.S. citizenship or lawful permanent residency (green card status)
as a condition for employment, unless otherwise required in order to comply with law, regulation, executive order, or
federal, state, or local government contract;
- infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party, or Content that
you do not have a right to make available under any law or under contractual or fiduciary relationships;
- constitutes or contains "link referral code," "affiliate marketing," "junk mail," "spam," "chain letters," "pyramid
schemes," or unsolicited commercial advertisements;
- constitutes posting essentially the same item or service to more than two classified categories or forums;
- includes links to commercial services or web sites, except as allowed in "services";
- that constitutes or contains any form of advertising or solicitation if: posted in areas of BuySellListings.com
which are not designated for such purposes; or emailed to BuySellListings.com users who have not indicated in writing
that it is ok to contact them about other services, products or commercial interests;
- advertises any illegal services or the sale of any items that are prohibited or restricted by applicable law;
- contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the
functionality of any computer software or hardware or telecommunications equipment;
- disrupts the normal flow of dialogue with an excessive number of messages (flooding attack) to the Site, or that
otherwise negatively affects other users' ability to use the Site;
- employs misleading email addresses, or forged headers or otherwise manipulated identifiers in order to disguise the
origin of Content transmitted through the Site; or
- contains protected multimedia content of any kind, such as audio or video files.
Additionally, you agree not to use the Site or Content on the Site to:
- contact anyone who has asked not to be contacted;
- "stalk" or otherwise harass anyone;
- collect personal data about other users for commercial or unlawful purposes;
- use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from the
Site, except for internet search engines (e.g. Google) and non-commercial public archives (e.g. archive.org);
- purposefully post Content in an irrelevant category, repeatedly post the same or similar Content;
- attempt to gain unauthorized access to our computer systems or engage in any activity that disrupts, diminishes
the quality of, interferes with the performance of, or impairs the functionality of, the Site; or
- attempt to or have unauthorized access to non-public areas of the Site.
No Spam Policy
You understand and agree that sending unsolicited email advertisements to any user of the Site
through the Site or the Company’s computer systems is expressly prohibited by these Terms. Any
unauthorized use of our computer systems is a violation of these Terms and applicable "anti-spam"
laws. Such violations may subject the sender and his or her agents to civil and criminal penalties.
Fee-based Service / Refund policy
To the extent permissible under law, you are responsible for any applicable taxes, whether
or not they are listed on your receipt or statement. You agree to pay, using a valid credit card,
the applicable fees and taxes (if any) set forth on the Site. We reserve the right, upon prior
notice to you, to change the amount of any fees and to institute new fees, effective at the end of
your current fee-based service period. All authorized charges will be billed to your designated
credit card account on the terms described in the specific offer. If payment cannot be charged to
your credit card or your payment is returned to the Company for any reason, the Company reserves the
right to either suspend or terminate your access to the unpaid-for Fee-based Services.
Refund Policy. All fees are quoted in U.S. Dollars.
All payments are final and non-refundable.
Scope of Use
You shall not use the BuySellListings.com website, in whole or in part, for any purpose that
is unlawful or prohibited by these Terms and Conditions of or for any purposes other than
those that are personal and non-commercial. You agree that you will not modify, copy, distribute,
transmit, display, perform, reproduce, publish, license, transfer, download, post, create derivative
works from, frame in another web page, use on any other web site, transfer or sell any information,
software, lists of users, databases or other lists, products or services provided through or obtained
from the BuySellListings.com web site, including, but not limited to the text, graphics, logos, photos,
and audio and visual files, without express written permission from the Company. This means, among other
activities, that you agree not to engage in the practices of "screen scraping," "database scraping," or
any other activity with the purpose of obtaining lists of users or other information. You agree that you
will not use the BuySellListings.com web site in any manner that could damage, disable, overburden, or
impair the BuySellListings.com website or interfere with any other party's use and enjoyment of the
BuySellListings.com website. You may not obtain or attempt to obtain any materials or information through
any means not intentionally made available or provided for through the BuySellListings.com website.
Unauthorized individuals attempting to access any area of this site in a prohibited manner may be
subject to prosecution.

User may provide links to the Site, provided (a) that the User does not remove or obscure, by

Users site does not engage in illegal or pornographic activities, and (c) User will discontinue
providing links to the Site immediately upon request by the Company.
Intellectual Property Rights and Ownership
The content of BuySellListings.com is owned by the Company and is protected by national and
international laws, treaties and conventions regarding intellectual property or proprietary
rights. The Company invites a User to view, use and download sample portions of content including,
without limitation, text, graphics, pictures, data, product descriptions, and audio and video
files on this website for a User¹s informational, non-commercial use; provided, however, that all
copyright, trademark and other proprietary rights notices are left intact. Please note that such
download and use of content to evaluate whether to purchase products or services from the
Company
or otherwise enter into a business relationship with the Company shall not constitute commercial use.

provided to you by such individual or company. Your interaction found on or through this Site, including but not
limited to, purchase of any product or service from an advertiser is a transaction solely between you and that
individual or company, and any question or dispute you may have regarding any such product or service should be
addressed directly to the individual or company. The Company has no responsibility or liability for any advertiser
or your relationship with such individual or company. In the event that you have a dispute with one or more other users,
you hereby release the Company, its officers, employees, agents and successors in rights from claims, demands and damages
(actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed,
arising out of or in any way related to such disputes and / or our service. If you are a California resident, you waive
California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not
know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially
affected his settlement with the debtor."
Modifications to Terms of Use and Content
The Company may modify this agreement or Privacy Statement at anytime in its sole discretion. Any modification is
effective immediately upon posting on this website, and you should check for any modifications or amendments each
time you access the site. If any modification to this agreement is unacceptable to you, you may immediately terminate
your subscription. However, if you do not terminate your registration, or continue to use BuySellListings.com, following
notice of any modification to this agreement, your continued use will mean that you have accepted that modification.

The Company has the right to terminate or restrict your access to the website and its content unilaterally and without
notice, in the event you violate any of these Terms of Use. The Company also reserves any and all remedies at law or

is prohibited. You further agree not to reproduce, duplicate or copy Content from the Site, and agree to abide by any

otherwise attempt to discover any source code contained in the Site. Without limiting the foregoing, you agree not

Governing Law and Attorney’s Fees.

Accordingly, if the User chooses to access the Site the User agrees to do so subject to the internal laws of the State of
California. In the event if either the Company or the User institutes suit in court against the other party, in connection
with any dispute or matter arising under this Agreement, the party which prevails in that suit shall be entitled to recover
from the other its attorney’s fees in reasonable amount, which shall be determined by the court and included in the judgment
in said suit. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or
related to use of the Site or the Terms must be filed within one (1) year after such claim or cause of action arose or be
forever barred.

Other Terms.
If any provision of this Terms of Use Agreement shall be unlawful, void or unenforceable for any reason, the other
provisions (and any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable
to the maximum possible extent. User agrees that this User Agreement and any other agreements referenced herein may be
assigned by the Company, in our sole discretion, to a third party in the event of a merger or acquisition. This Agreement
constitutes the entire agreement between you and the Company and it supersedes all prior or contemporaneous communications,
promises and proposals, whether oral, written or electronic, between you and the Company with respect to this Web site and
information, software, products and services associated with it.
